Requirement of Wali for Online Marriage/Online Nikah

There is a requirement of a wali for a bride in Middle Eastern countries like Saudi Arabia, the United Arab Emirates, Oman, Iraq, etc. Pakistani marriage laws do not contain this requirement. In Pakistan, an online marriage (Nikah) does not require a wali. In Pakistani Nikahnama, a new clause states that the couple must appoint a Vakeel / Attorney / Proxy / Representative on their behalf.

REQUIREMENT OF THE ONLINE MARRIAGE (NIKAH ONLINE)
  • It is required that both parties are adults, i.e. 18 years old or older. (In Pakistan, the minimum legal age of marriage is 18 years and above, however, the sharia age of marriage is puberty).
  • (Their wills should be free and there shouldn’t be any pressure or force used for nikkah/marriage.)
  • Similar to the traditional marriage ceremony, the Online Nikah/Marriage should also be performed in the presence of two witnesses as well as a Qazi.
  • Finally, the Mehar is also known as a dower amount, which is agreed upon by the bride and groom
PROCEDURE OF ONLINE MARRIAGE (NIKAH ONLINE)
  1. For the bride and groom, we will need their passports and ID cards (we can receive them via email).
  2. The date and time of the Online Nikah will be set, and the bride and groom will be invited to participate in a video call
  3. The bride and groom are required to consent to the Nikah Khuwan reciting the Khudba-e-Nikah followed by the Ejab-o-Qabool (asking for their consent). Also present will be two Muslim witnesses and a Wakeel/attorney/proxy
  4. The Nikah documents will be processed after the bride and groom sign the Nikah documents. Our office will submit the marriage registration certificate on behalf of both parties. The Union Council will issue both the Nikahnama (Marriage Contract) and NADRA Marriage Certificate.
